1. Introduction
Welcome to the Leave Management System provided by ToBeShore AB. By accessing or using our software, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Eligibility
Our system is available to companies, organizations, and individuals globally. Users must be 18 years of age or older or have the legal capacity to enter into a binding agreement.
3. Free Trial and Subscription
We offer a free trial for new users. Continued use of the service after the trial period requires a valid subscription through Microsoft Azure Marketplace billing. By subscribing, you agree to Azure’s billing terms.
4. Service Description
Our Leave Management System is a cloud-based Software-as-a-Service (SaaS) platform designed to help organizations manage employee leave and attendance. The service provides a range of features, including but not limited to:

Leave Tracking – Submit, approve, and monitor employee leave requests.

Holiday Calendar Management – Configure and manage company-wide or regional public holidays.

Team Calendars – View and coordinate leave schedules across teams and departments.

Report Exports – Generate and export leave and attendance reports for record-keeping or compliance (Coming Soon).

AI Assistance (Azure Bot) – Get interactive support and quick answers through the built-in Azure Bot (Coming Soon).
5. Account Responsibility
Users are responsible for maintaining the confidentiality of their login credentials. All actions taken using your account are your responsibility.
6. Acceptable Use
You agree to use the service only for lawful purposes. Prohibited activities include, but are not limited to:

Accessing unauthorized data (e.g., from another tenant)

Reverse engineering or copying the platform

Uploading malicious or harmful content

Violating applicable laws and regulations
We reserve the right to suspend or terminate accounts engaged in prohibited behavior.
7. Data Ownership and Access
All data entered into the system belongs to the respective customer (organization or individual). ToBeShore AB may access your data only for:

Technical support

System maintenance

Product improvement
We do not sell any data to third parties.
8. Data Export and Deletion

Export: Users can export leave and attendance data in report format.

Deletion: Data deletion is not supported through the system. Requests must be made directly to support.
9. Data Retention
We store active data for 2 years in our transactional database. After that, it is archived to Azure Storage for long-term retention.
10. Customization & Integrations
We provide custom development and system integrations upon request. Additional fees and a separate agreement may apply.
11. Support and SLA
Support is available via email at support@tobeshore.freshdesk.com.
A Service Level Agreement (SLA) applies to paid subscriptions. Contact us for SLA terms.
12. Limitation of Liability
To the maximum extent permitted by law, ToBeShore AB shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to data loss, service interruption, or loss of profits. Our total liability under this agreement shall not exceed the amount you paid for the service during the 12 months preceding the claim.
13. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When changes are made, we will notify users through the system or via email. Continued use after such updates constitutes acceptance of the new terms.
14. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of Sweden, without regard to its conflict of law principles.
